Terms & Conditions
These terms explain the guidelines for using the Premier Tropicals website and purchasing live fish, aquatic plants, aquarium decor and related products from us.
Last updated: September 2026
1. Agreement to these terms
By visiting this website or placing an order, you agree to these Terms & Conditions, our shipping information and our Live Arrival Guarantee. If you do not agree, please do not use the site or place an order. Premier Tropicals may update these terms from time to time; the version posted here applies to orders placed after the update.
2. Products and availability
We make every effort to keep product descriptions, photographs, sizes, sexing, coloration and availability accurate. Live animals are individual and may naturally vary from photographs. Inventory can change quickly, and we may limit quantities or cancel an order when a product becomes unavailable, cannot be safely shipped or was listed with an obvious error. If we cancel an order, we will refund the amount paid for the unavailable item.
3. Orders and payment
An order is submitted when you complete checkout, but it is not accepted until we confirm it. You are responsible for providing a correct name, shipping address, phone number and email address. We may contact you to verify order details or to coordinate a safe shipping date. Prices are shown in U.S. dollars and may change without notice; the price displayed at checkout applies to the order.
4. Live fish shipping
Live fish are shipped by overnight express on our available shipping days, generally Monday through Wednesday, to reduce weekend carrier delays. We may hold an order for weather, carrier service interruptions, holidays or other conditions that could put the animals at risk. We will contact you when a hold or reschedule is needed. Please ensure that someone is available to receive the package promptly and that the delivery location is safe and suitable for live animals.
5. Live Arrival Guarantee and DOA claims
Our Live Arrival Guarantee is described in our shipping and DOA policy. To be eligible, you must be available at the first delivery attempt, follow the acclimation instructions and report a deceased fish within two hours of that attempt. Clear photographs of the fish inside the unopened bag and outside the bag are required. Approved claims may be resolved with a replacement on a future shipping run or a refund for the fish, at our discretion or as otherwise agreed. Shipping charges are non-refundable, and refused, returned or improperly handled packages are not covered.
6. Plants, decor and dry goods
Aquatic plants, rocks, substrate and other dry goods may ship separately from live fish. Natural products can vary in shape, size, color and texture. Inspect all items when they arrive and contact us promptly at sales@premiertropicals.com if an item is damaged or incorrect so we can review the issue and determine an appropriate remedy.
7. Cancellations, returns and refunds
Contact us as soon as possible if you need to change or cancel an order. Once an order has been packed or shipped, changes may not be possible. Because live animals and certain aquatic products cannot be safely resold, returns are not accepted for live fish unless we authorize them in writing. Any approved refund is issued to the original payment method, subject to the applicable shipping and DOA terms.
8. Responsible care
You are responsible for maintaining an appropriate aquarium, water quality, stocking level, quarantine process and ongoing care for any animals you purchase. Our care guides are educational information and are not a substitute for your own research or advice from a qualified aquatic professional. Do not purchase an animal unless you can provide safe, suitable long-term care.
9. Website use and intellectual property
The content on this website, including text, photographs, branding, logos and design, belongs to Premier Tropicals or its content providers and may not be copied, modified, republished or used commercially without permission. You agree not to misuse the site, interfere with its operation or submit inaccurate, unlawful or harmful information.
10. Limitation of liability
To the fullest extent permitted by law, Premier Tropicals is not responsible for indirect, incidental or consequential losses arising from use of the website, carrier delays, weather events, aquarium conditions or the care of purchased animals. Our responsibility for an approved product issue is limited to the remedies described in these terms and the applicable order, shipping or DOA policy.
11. Contact
Questions about these terms or an order can be sent to sales@premiertropicals.com or 904-453-0436. Premier Tropicals is based in Green Cove Springs, Florida, and ships nationwide.
12. Interstate orders
Customers ordering from outside Florida are responsible for complying with applicable laws and regulations governing possession of live fish and aquatic animals in their state and locality. We may refuse an order when we determine that shipment would violate applicable law or create an unreasonable risk to the animals.
13. Taxes
Applicable sales and other taxes will be calculated and collected when required by law. Florida generally requires sales tax on taxable tangible personal property sold online and delivered to Florida customers. Applicable delivery charges may also be taxable depending on how the delivery charge is structured.
14. Payment
Orders must be paid in full before shipment unless we have expressly agreed to another arrangement. We reserve the right to cancel an order if payment cannot be successfully verified or processed.
15. Fraudulent or suspicious orders
We reserve the right to cancel orders that appear fraudulent, unauthorized, or otherwise suspicious. Additional verification may be requested before an order is shipped.
16. Force majeure
We are not responsible for failure or delay in fulfilling an order caused by circumstances beyond our reasonable control, including severe weather, natural disasters, transportation interruptions, government actions, disease outbreaks, power outages, or other extraordinary events. When reasonably possible, we will work with the customer to reschedule shipment or determine an appropriate resolution.
17. Limitation of liability
To the maximum extent permitted by applicable law, our liability arising from any purchase will be limited to the amount actually paid for the affected product or order. Nothing in these Terms & Conditions is intended to waive any rights or protections that cannot legally be waived.
18. Changes to these terms
We reserve the right to modify these Terms & Conditions from time to time. Updated Terms & Conditions will be posted on our website with an updated effective date.
